More Trouble for Apple: Nokia Claims iPad Infringes

Apple has made some rotten moves, according to the Finnish phone maker, Nokia. The company is in the midst of a legal patent infringement battle against Apple and has just added another claim.
Along with the 10 patents that Nokia has already claimed Apple is infringing, new documents indicate the recently launched iPad 3G infringes on five more.
The company filed additional claims May 5 in the U.S. District Court of Western Wisconsin, claiming Apple infringed on its speech and data patent, its design of application that uses positioning data patent, and three patents on antenna design.
The battle between the two phone makers began in October 2009, when Nokia filed a suit against Apple claiming the company had infringed on patents that cover wireless data, security, encryption and speech coding. All the patents were used in the creation of Apple's iPhone, iPhone3G and iPhone 3GS, according to Nokia.
Apple (AAPL) countersued Nokia (NOKA) in January saying Nokia's phones infringe on 13 of its patents. Nokia asked, in turn, for the court to dismiss the counter suit.
Protecting Its Assets
Nokia said it has negotiated license agreements with 40 other handset makers including the top mobile phone providers. It also attempted to form a licensing agreement with Apple, but the discussions did not progress to any agreement.
Apple's unauthorized use of Nokia's technology has caused the company financial harm and damaged its reputation as a business, according to the company's most recent filings with the court. Nokia further claims that the unauthorized use of its patents allow Apple "to charge less for its products because it does not have to recover the costs of development of the technology used in the device."
The iPhone maker also gains more market share that it would not have obtained if its products had to bear the costs for the patented technology, Nokia states. As a result, Nokia claims it lost its portion of the market share for the time the iPhones were used.
Apple holds the second largest share of the U.S. smartphone market with 25.1 percent, according to Comscore. Worldwide, Apple sold 8.7 million iPhones and had 16.6 percent of the smartphone sales in the fourth quarter, according to ABI Research.
Nokia is asking for a jury trial, undisclosed damages, and attorney and court fees.
Patent Battle Marches On
The legal sector will be busy in the next few years with patent lawsuits similar to Nokia's, analysts said.
"Expect the patent battles to grow for the overall industry as you continue to see players coming into the mobile [arena] from the PC and the Internet worlds," said Carolina Milanesi, vice president at research firm Gartner, in the Mobile Devices Technology and Service Provider Research group. "We were reminded again last week of the importance of patents when HP announced plans to acquire Palm and cited the 1,500 patents Palm has as one of the key assets."
The question many are still asking is: Why doesn't Apple just pay Nokia's licensing fees like everyone else? If Nokia has negotiated license agreements with 40 other phone and device makers, why couldn't Apple come to agreement with them?

EU creates $1 trillion package to save euro

BRUSSELS – The European Union put up a staggering $1 trillion Monday to contain its spreading government debt crisis and keep it from tearing the euro currency apart and derailing the global economic recovery.
Analysts said the huge sum supplied the "shock and awe" markets had been waiting for for weeks, at least in the short term, and the euro and stocks soared on the news.
European leaders negotiated into the early hours of Monday before reaching a deal in which governments that use the euro would join the EU and International Monetary Fund in putting up euro750 billion in loans available to prop up troubled governments.
The European Central bank will buy government and private debt to keep debt markets working and lower borrowing costs, a crisis measure dubbed the "nuclear option," while the U.S. Federal Reserve joined with other central banks in the effort, reactivating a currency swap program used during the earlier stages of the financial crisis to ship dollars overseas to be pumped into banking systems as short-term credit.
The overnight decision immediately jumpstarted markets worldwide. The euro immediately shot back to life and up to $1.30, recovering from Friday's 14-month low of $1.2523.
Stocks too basked in the glow. France's CAC-40 stood out in Europe, surging 285.08 points, or 8.4 percent, to 3,677.67. Athens' main index was up nearly 10 percent and Lisbon's PSI 20 jumped 9 percent too.
Japan's Nikkei 225 stock average rose 1.5 percent and Hong Kong's Hang Seng index added 1.3 percent. European markets jumped higher — major indexes were up more than 3 percent — and Wall Street was also expected to surge on the open, with Dow futures also 3.0 percent higher.
Officials acted after ominous slides in world stocks and the euro last week that raised fears that the debt crisis would spread from heavily indebted Greece to other financially weak countries such as Spain and Portugal. It reached the point where President Barack Obama discussed the crisis by phone with German Chancellor Angela Merkel and French President Nicholas Sarkozy.
Policy makers worried it could shake the world economy the way the bankruptcy of U.S. investment bank Lehman Brothers did in 2008, making banks fearful of lending to businesses, hammering stocks and killing off economic recovery.
It also raised long-term worries that the crisis would force a weaker member such as Greece out of the euro.
Analysts said the measures had put out the fire for now by eliminating fears that governments would lack funds to pay off their debts. But several raised long-term worries about spreading debt of budget sinners to more responsible governments, and pointed to the lack of tough rules to keep debt from piling up again.
"It buys time. We don't know if it will be enough. They're trying to give the impression that they're still united. They've bought some breathing space but that's all," said Song Seng Wun, an economist with CIMB-GK Research in Singapore. "This perhaps just postpones the inevitable, the euro may have to ultimately give way, that's the worst case scenario."
Jeremy Batstone-Carr from Charles Stanley stockbrockers said the underlying problem won't be solved unless governments stop piling up so much debt. "The last thing you give a drunk is another drink," he said. "Put differently, you cannot make any nation that is unable to service its accumulated debts more credit worthy by extending more credit."
European Commission President Jose Manuel Barroso promised tougher rules for member countries' spending.
On Wednesday, EU officials will propose tougher sanctions for financially wayward nations and more coordination between the governments on their economies. "We need stronger coordination, economic policy coordination," he said. It will be discussed by EU finance ministers next week.
Under Monday's three-year plan, the European Commission — the EU's governing body — will make euro60 billion ($75 billion) available while countries from the 16-nation eurozone would promise backing for euro440 billion ($570 billion). The IMF would contribute an additional sum of at least half of the EU's total contribution, or euro250 billion.
"We shall defend the euro whatever it takes," EU Commissioner Olli Rehn said after an 11 hour-meeting of EU finance ministers that capped a hectic week of chaotic sparring between panicked governments and aggressive markets.
Officials hope the massive sums will deter currency speculators from betting on a euro collapse after political posturing and soothing words failed to convince investors that Greece's financial implosion could be contained.
Markets had battered the euro and Greek government bonds even as EU leaders insisted for days that Greece's problems were a unique combination of bad management, free spending and statistical cheating that doesn't apply to other euro-zone nations.
Market jitters also partly contributed to a nearly 1,000-point drop in the Dow Jones industrials last Thursday. The Securities and Exchange Commission is meeting with heads of exchanges Monday to discuss how conflicting trading rules may have exacerbated the historic stock market plunge.
In the end, even longtime skeptic Germany realized Europe had to show the money after financial attacks on Greece's debt seemed poised to spread to other weak European nations such as Portugal and Spain. Fear of default led to investors demanding high interest rates that Greece could not pay, forcing it to seek a bailout. Many feared market skepticism would make Portugal and Spain pay more and more to borrow, worsening their plight.
Spain and Portugal have committed to "take significant additional consolidation measures in 2010 and 2011," a statement from EU finance ministers said. The two countries will present them to EU finance ministers at their meeting on May 18.
"We are facing such exceptional circumstances today and the mechanism will stay in place as long as needed to safeguard financial stability," the ministers said.
Merkel said her government would approve the rescue plan on Tuesday before parliament gave it "quick but thorough" consideration.
Separately, eurozone leaders on Saturday gave final approval for a euro80 billion ($100 billion) rescue package of loans to Greece for the next three years to stave off default. The IMF also approved its part of the rescue package — euro30 billion ($40 billion) of loans — on Sunday.
The Fed's move to back the euro defense plan reopens a program put in place during the 2008 global financial crisis under which dollars are shipped overseas through foreign central banks. In turn, these central banks can lend the dollars out to banks in their home countries that are in need of dollar funding in so-called swap agreements.
The Fed said action is being taken "in response to the reemergence of strains in U.S. dollar short-term funding markets in Europe" and to "prevent the spread of strains to other markets and financial centers." A "swap" line with the Bank of Canada provides up to $30 billion. Figures weren't provided for the other central banks involved. They include the Bank of England, the European Central Bank, the Swiss National Bank, and the Bank of Japan.

Coca Colla hopes to create a buzz in Bolivia

The beverage has a red-and-white label, tastes ultra-sweet, gives you a buzz and - says its producer - it keeps you awake.

But it is not the drink with similar effect and a similar name you might think it is.

An unlikely newcomer has made the world of soft drinks a little more crowded: Bolivia has started producing a new fizzy drink using the coca leaf.

It is called "Coca Colla" after the Colla people, the Andean tribes who cultivate coca in the areas bordering Bolivia, Chile and Argentina.

For some a matter of indigenous pride, for others another sign of Bolivia's growing anti-US feelings, this humble local initiative has set its sights on competing domestically with giants such as Coca-Cola and Red Bull.

The new "energy soft drink" is made by a private company, with a modest initial investment of a $1,000 (£650), but it is backed up by a government policy of industrialising the cultivation of the coca leaf.

The leaf is a key element in the Andean people's culture and economy. However, it is also cocaine's raw material.

That association with drugs is a motivating influence on the drink's creator Victor Ledezma.

"I want to get to the whole world with my coca-leaf-based drink," says Ledezma, a coca farmer from El Chapare region in central Bolivia.

"Coca has a lot of potential … this can change the image of Bolivia as being a drug-trafficking country," he believes.

According to Mr Ledezma, Bolivia's new ally, Iran, has already expressed an interest, having ordered two million bottles.

And some countries in the region, members of the left-wing Alba bloc - mainly Venezuela and Paraguay - are considering not only importing, but also financing Mr Ledezma's project.

"I've developed my own secret formula. I started making the drink at home, based on my beloved but otherwise reviled coca leaf and outsourcing the bottling process," Mr Ledezma says.

"Now we are building a plant in Santa Cruz and aiming to have investments for at least $1m. That's for a start. The whole world should know that coca, besides from its good taste, is good for body and the soul," Mr Ledezma adds.

Beverages derived from coca leaves are not a new idea.

In the late 1800s and early 1900s, an Italian entrepreneur, Angelo Mariani, sparked a revolution with his coca-based wine, 'Vin Mariani'.

The drink offered "health, strength, energy and vitality" and was even awarded official recognition by one of its consumers and fans, the then Pope Leo XIII.

Most recently, coca leaves seem to be among the elements in the formula of the Red Bull Cola energy drink.

But most famously, coca leaves helped to give the kick in Coca-Cola's original formula. The company dropped cocaine from its recipe more than 100 years go, but the secret formula still calls for a cocaine-free coca extract.

The Coca-Cola Company is said to import eight tons of coca leaves from South America each year, mainly from Peru.

"The coca leaf has three alkaloids. Extracted from the leaf and concentrated into cocaine with chloride, the coca alkaloid is highly stimulating and, potentially, very addictive," explains Dr Jorge Hurtado, a local psychiatrist and coca expert who heads the International Coca Research Institute.

"However, the small dose present naturally, and unprocessed, in coca leaves provides only a slight energising sensation and it is not addictive; it carries less of a kick than a cup of coffee.

"The same applies to the Coca Colla or other coca-based products like toothpaste, flours or sweets," Dr Hurtado adds.

Trade ban

Even so, with the notable exception of Coca-Cola, most products using coca leaves are banned in most nations beyond the Andes by strict trade regulations.

So for Coca Colla, exporting the beverage widely would require the International Narcotics Control Board of the United Nations to take the coca leaf off the list of dangerous drugs, where it has been since 1961.

And it would also require modifying the current local law, which prevents exports of any product derived from the coca plant.

Bolivian President Evo Morales has yet to indicate whether the law will change.

But Mr Morales, himself a coca grower, has fought for the rights of coca growers and called for the United Nations to lift the ban on coca, criticising the US for its opposition to any change.

Yet Bolivian law currently allows only 12,000 hectares of coca plants to be planted and its purposes must be traditional - for chewing, for tea and for use in indigenous rituals.

But with widespread plans of industrialisation of the shiny green leaf, Mr Morales is pushing to increase the area used to grow coca to 20,000 hectares.

In reality, coca cultivation is far greater than that. A recent report published by the United Nations Office on Drugs and Crime states that, in 2008, approximately 30,200 hectares of coca were under cultivation in two out of the country's nine departments.

The reality is that coca leaves fetch far higher prices than most food crops and cultivation is hard to resist for farmers in one of South America's poorest countries.

The government's hope is that, by supporting coca's other uses, it will help some farmers avoid the temptation of cocaine trade. It says legal coca production makes enough to support 300,000 people.

A government source told the BBC that they were in the final stages of analysing the product and would soon provide financial support to its producers.

"The aim is to provide greater social benefits to producers and suppliers of the raw material.

"This is great for Bolivia and will be great for the coca leaf, because then people won't only talk just about the negative side of coca-derived products", the source said.

"And there's more to it than that. This is a matter of national pride. Soon, people will stop talking about 'God, Country and Coca-Cola'; they'll be talking of '[Andean Goddess] Mother Earth, Bolivia and Coca Colla.'"
